COLLECTION AND LITIGATION PROCEDURES

Accounts assigned to CAB are immediately placed with our in-house adjusters. If we are unable to obtain prompt payment or a definite written commitment for payment, the client is then contacted for the purpose of requesting permission to file a lawsuit.

We have in-house attorneys, one of whom is a principal of our agency; thus, it is possible to utilize timely and cost effective litigation as a proven collection method. Indeed, it is our willingness to litigate which distinguishes CAB from all other collection agencies. Our experience confirms what common sense tells us: Lawsuits often are necessary to collect money.

In many instances, the filing of a lawsuit prompts the debtor to immediately enter into a mutually agreeable payment schedule which is memorialized and enforceable pursuant to a court approved stipulation for entry of judgment. This stipulation provides that in the event of a default in payment, the court will enter judgment for the unpaid balance, thereby allowing for the immediate execution of the debtor's assets.
